These Terms of Service (“Terms”) govern your access to and use of AMK Global Group’s website (https://amkglobalgroup.com) and, where applicable, the general terms under which we provide recruitment, advisory, and immigration support services. 

By using our website, submitting information through it, or engaging with our services, you confirm that you have read and understood these Terms and agree to be bound by them. 

If you are using our website or services on behalf of an organisation, you confirm that you have authority to accept these Terms on that organisation’s behalf. 

We may update these Terms from time to time. The updated Terms will be posted on our website with a revised “Last updated” date. 

Description of Services 

We are a regulated recruitment and advisory firm providing services that may include: 

  • Domestic recruitment and search support. 
  • International talent sourcing and cross-border recruitment support. 
  • Employer advisory services, such as hiring strategy support, process guidance, and market insights. 
  • Immigration support services for employers and skilled professionals, which may include eligibility assessment support, documentation coordination, application process support, and liaison with relevant stakeholders, as agreed in writing. 

Service availability, scope, deliverables, timelines, and responsibilities may vary by engagement and jurisdiction. Where services require specific authorisation, licensing, or local representation, we will only provide those services through appropriately authorised personnel and/or qualified partners, and the precise scope will be set out in an engagement letter, statement of work, or other written agreement. 

Use of the Website 

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the website. 

You must not: 

  • Attempt to gain unauthorised access to our systems or data
  • Introduce malware, harmful code, or attempt to disrupt the website
  • Scrape, harvest, or collect data from the website without our written permission
  • Misrepresent your identity or submit false information
  • Use the website to send spam or unsolicited communications. 

We may suspend or restrict access to the website if we believe it is being misused or poses a security risk. 

Client Responsibilities 

If you engage our services (as an employer client or as an individual professional), you agree to: 

  • Provide complete, accurate, and up-to-date information
  • Promptly notify us of changes that may affect recruitment or immigration outcomes (e.g., employment status changes, document expiry, role changes)
  • Respond to reasonable requests for information or documents within agreed timelines
  • Use our outputs (such as candidate shortlists, advisory deliverables, or process support) responsibly and in line with agreed scope
  • Comply with applicable professional, employment, and ethical expectations relevant to your circumstances. 

You acknowledge that our ability to provide effective services depends on timely cooperation and the quality of information provided. 

Employer and Candidate Responsibilities 
Employer responsibilities 

Employers and hiring organisations engaging us agree to: 

  • Provide accurate job requirements, location, compensation details, and selection criteria
  • Act fairly and professionally in candidate assessment, interviews, and feedback
  • Comply with applicable employment and workplace principles (including non-discrimination and fair hiring practices
  • Confirm that any offers made are made by the employer (or hiring organisation) and that employment contracts are between employer and candidate
  • Handle candidate information responsibly, confidentially, and in accordance with applicable data protection principles. 
Candidate responsibilities 

Candidates and work-seekers engaging with us agree to: 

  • Provide accurate information about identity, skills, qualifications, work history, and right-to-work/immigration status (where relevant)
  • Ensure that submitted documents are genuine and not misleading
  • Act professionally during screening and interview processes
  • Disclose restrictions or conflicts that could affect placement or immigration processing (where appropriate). 

Where reference checks or screening are considered, these will be handled in line with applicable principles and engagement scope. 

Fees and Payments 
Employer fees 

Unless otherwise agreed in writing, fees for employer services (including recruitment, retained search, advisory, and associated support services) will be set out in a written proposal, engagement letter, or statement of work. 

Invoices are payable in accordance with the payment terms stated on the invoice or in the engagement documentation. Late payment may result in service suspension. 

Candidate fees 

As a default position, and consistent with fair recruitment expectations, we do not charge candidates/jobseekers recruitment fees for access to employment opportunities.  

If we offer optional, clearly distinguishable candidate-paid services (for example, coaching or document support) these will be described separately, priced transparently, and provided only where permitted and where you choose to purchase them. 

Third-party costs and government charges 

Some services may involve third-party charges (for example, translations, document procurement, courier fees, medicals, qualifications verification, or government application fees). Unless stated otherwise in writing: 

  • Such costs are payable by the client (employer or individual) directly to the third party or reimbursed to us if we pay them on your behalf
  • Third-party costs are typically non-refundable once incurred. 
Intellectual Property 

We own (or license) the intellectual property rights in our website content, branding, and materials, including text, graphics, logos, and documents, unless otherwise stated. 

You may view and print website pages for your own internal use, but you must not reproduce, distribute, modify, or commercially exploit our content without our prior written permission. 

Where we provide deliverables (e.g., advisory reports, process documents, or templates), permitted use will be defined in the engagement documentation. 

Limitation of Liability 

We aim to provide services with reasonable care and professionalism. However: 

  • Recruitment outcomes depend on employer decisions, candidate decisions, market conditions, and third-party factors outside our control
  • Immigration outcomes depend on the requirements, processes, and decisions of competent authorities and may change without notice; and 
  • We cannot guarantee timelines, approvals, offers, placements, or outcomes. 

To the maximum extent permitted by applicable mandatory principles: 

  • We exclude liability for indirect or consequential losses (such as loss of profit, loss of business opportunity, reputational loss, or loss of anticipated savings); 
  • Our total liability arising out of or in connection with the website (or these Terms) is limited to the extent set out in the applicable engagement documentation, or if none applies for website-only use, to a reasonable amount reflecting the nature of the issue. 

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or deliberate misconduct. 

Termination of Services 

Either party may terminate an engagement in accordance with the written engagement documentation. Where no written terms exist for a specific engagement, either party may terminate with reasonable notice. 

Upon termination: 

  • Fees accrued up to the termination date remain payable
  • Any agreed wind-down activities may be billed as agreed
  • Handling of personal information will follow our Privacy Policy and any engagement-specific requirements. 
Governing Principles 

Because we operate internationally, the governing terms for a specific engagement may depend on the contracting entity, service location, and agreed scope. 

Unless otherwise stated in a written agreement for a particular engagement: 

  • We will seek to resolve issues promptly, professionally, and in good faith; and 
  • Where a dispute arises, the parties will aim to resolve it through good-faith discussions and, where appropriate, structured escalation processes (and alternative dispute resolution where mutually agreed). 

Any engagement letter or statement of work may specify additional governing terms relevant to that engagement.
